These Terms and Conditions govern the use of our website and the purchase of products and services from Novarq Ltd., a company registered in Croatia (EU). By accessing our website, browsing, or making a purchase, you agree to be bound by these Terms.

Throughout these Terms, “Novarq,” “we,” “us,” and “our” refer to Novarq Ltd.

Scope of Services

We sell physical goods (hardware products) through our online store. These Terms and Conditions apply exclusively to purchases made through the website and govern the sale of such products to customers worldwide.

In addition, upon request we may offer custom engineering and consulting services, such as software integration, hardware modification, and technical support. These services are not part of website transactions and are instead governed by separate service agreements or quotations between Novarq and the customer.

Rates, deliverables, and specific terms for these services are defined individually and do not fall under the scope of these Terms and Conditions.

Orders and Contract

When you place an order, you are making an offer to purchase. A contract is formed once we confirm your order and receive payment.

Orders placed by Croatian customers cannot be completed directly through the online checkout. Croatian customers must request a proforma invoice via our request form, after which we will confirm the details by email. For all other customers, purchases can be made directly through our online store.

We reserve the right to refuse or cancel any order at our discretion, for example if payment is not successful or if fraud is suspected.

Prices and Payment

All prices are shown in euro (EUR) unless otherwise stated. For EU customers, VAT is included where applicable. If multiple currencies are offered, local currencies may be displayed depending on your location.

Payment must be completed at checkout using the methods we make available (such as credit card, PayPal, or other processors). Payments are processed securely by our payment partners; we do not store full card details.

Invoices are issued directly by Novarq in accordance with applicable tax regulations. For B2B transactions within the EU, reverse charge VAT applies where applicable.

Shipping and Delivery

Shipping costs are calculated at checkout based on product dimensions, weight, quantity, and customer location.

Additional costs such as customs duties, import taxes, brokerage fees, or local surcharges are not included in our prices and remain the sole responsibility of the customer.

Delivery times are estimates only. We are not liable for delays caused by carriers, customs, or events beyond our control. Title and risk of loss pass to you once the goods are handed over to the carrier.

Warranty and Returns

All our products are covered by the mandatory EU legal warranty of 2 (two) years, which applies equally to all customers worldwide.

This warranty covers manufacturing defects and non-conformities present at the time of delivery.

If a product is defective or non-conforming, you are entitled to request repair, replacement, or, if that is not possible, a refund, in accordance with applicable EU consumer protection law.

The warranty does not cover:

  • Normal wear and tear,

  • Damage caused by misuse, modification, improper installation, or unauthorized repair,

  • Accidental or environmental damage (e.g. water, lightning, mechanical shock).

Use of Website

You agree to use our website and services only for lawful purposes. You must not attempt to interfere with the operation of the website, introduce malicious code, or use the services in a way that violates applicable law.

We reserve the right to suspend or terminate your access if you misuse the services or violate these Terms.

Intellectual Property

All trademarks, logos, images, text, and other content on our website are the property of Novarq or our licensors. You may not copy, distribute, or reuse our content without our prior written permission, except as allowed by law for personal use.

Limitation of Liability

To the fullest extent permitted by law, Novarq is not liable for any indirect, incidental, or consequential damages (such as lost profits, data loss, or business interruption) arising from your use of our website, products, or services.

Nothing in these Terms limits liability where it cannot be excluded by law, including for defective products or mandatory consumer rights.

Governing Law

These Terms and any purchases made from Novarq are governed by the laws of Croatia and the European Union. All customers worldwide benefit from the mandatory protections granted by EU consumer law.

Changes

We may update these Terms to reflect changes in our business, products, or legal requirements. Updates will be posted on this page with a revised “Last Updated” date. Your continued use of our website after changes are posted constitutes acceptance of the updated Terms.
